22 Meadowbrook Road, Request for Determination of Applicability, Patricia & Bruce Bishop
Patricia Bruce presented the proposal to replace the old footbridge across the intermittent stream in her back yard with a new bridge of red cedar, 8' long and 3' wide. This will be about the same size as the existing bridge, which is rotting.
Rebecca Weissman moved to issue a negative Determination of Applicability, Rhonda Ryznar seconded, and the motion carried 4 – 0. Determination was signed by Committee
Ms. Bruce said she wants to plant native species of plants near the stream. The Committee found that doing so is exempt from the Wetlands Protection Act according to the regulations in 310 CMR 10.02.

50 Windsor Road, Extension Permit (DEP File #324- 442), Nancy Westenberg
The Committee received a request for an extension to the Order of Conditions, due to expire in October, for a project still in progress.
Marc Taylor moved to issue a one-year Extension Permit, Rhonda Ryznar seconded, and the motion carried 4 – 0.
23 Wingate Road, Notice of Intent (DEP File #324-531), D. Michael Collins
Michael Collins presented the plan for additions to the rear of the existing house, extending up to 10 feet into the 100-foot buffer zone of wetland. The addition would be on existing lawn. One tree would be removed. No regrading involved.
The Committee noted that the existing lawn now encroaches onto Town park land, and so a plan for restoration of that area will be needed and must be approved by this Committee.
Rhonda Ryznar moved to close the hearing and issue an Order of Conditions at the next meeting, to include Conditions requiring an encroachment restoration plan. Rebecca Weissman seconded, and the motion carried 4 – 0.
144 Glen Road, Request for Determination of Applicability, Garrett and Rebecca Solomon
Garrett Solomon and Steve Poole presented the plan to install a 40' by 20' swimming pool in the backyard and to replace the existing infiltration structure with two new ones, in order to make room for the pool. The new infiltration system would have 30% added capacity. The pool's filters would be disposable rather than backwash. The fence would go on top of the rear retaining wall.
The applicant also added a request to remove one dead tree at the edge of the back lawn. He also plans to add an irrigation well.
Marc Taylor moved to issue a negative Determination of Applicability, with the condition that the infiltration system be replaced as shown and noted on the plan. Rhonda Ryznar seconded, and the motion carried 4 – 0. Determination was signed by Committee..

Annual Report:
The Committee requested that a single sentence be added to the draft WPC annual report about fines issued and collected for violations, if publishing and approving deadlines allowed. Otherwise, the report was approved as drafted.
Motion by Rhonda Ryznar, seconded by Rebecca Weissman, approved 4 – 0.
35 Overbrook Drive, Notice of Intent (DEP File #324-532), Therese Krasner
Owner Therese Krasner and builder Nick Sivieri presented the proposal to build an addition to the house at 35 Overbrook Drive, within the outer riverfront area of Bogle Brook. The addition would have no basement, so only a foundation and frost wall would need to be excavated. The area is now gravel and level, but 22 feet above the stream. Roof drainage would be pitched toward the driveway. No trees would be removed.
Marc Taylor moved to close the hearing and issue the Order of Conditions later. Rebecca Weissman seconded, and the motion carried 4 – 0.
The applicants then added that they planned a deck, 7 to 9 feet wide, around the back and side of the house, over existing lawn. The Committee noted that this is exempt under the state regulations (310 CMR 10.02).
The applicant will submit a revised plan, showing the proposed deck.

15 Winding River Circle, Enforcement Compliance, Larry Gottesdiener
A draft letter to Mr. Gottesdiener, following the discussion at the August 3 meeting, was given final consideration.
On a motion by Rhonda Ryznar, seconded by Mary Jane O’Donnell, the letter was approved as drafted, including its requirement for a $10,000 penalty, by a vote of 2 – 1. (Rebecca Weissman recused herself from the vote because of professional association with the owner's restoration consultant. Marc Taylor voted in opposition to the amount of the fine, stating that the owner's expenses for restoration were sufficient.)
57 Whiting Road (DEP #324-527), Order of Conditions was approved as drafted, with the Condition that the Committee reserved the right to impose a penalty under the provisions of the Wellesley Wetlands Protection Bylaw.
Committee reorganization was again postponed because of the absence of two full members.
The meeting adjourned at approximately 10:00 pm.
The next meeting is tentatively scheduled for October 19, 2006.
